It’s true. Pacific Legal Foundation’s challenge to the Affordable Care Act goes to the very heart of Obamacare – the Individual Mandate that nearly every American must purchase a federally prescribed health insurance plan or pay a charge to the federal government. It’s true that the law is up and running, but the courts still have a duty to hold the law accountable to the Constitution.
Our lawsuit, now in the D.C. Circuit Court of Appeals, declares that the individual mandate tax is unconstitutional under the Origination Clause – Obamacare started in the Senate; but the Constitution’s “Origination Clause” (Article I, Section 7) requires that taxes start in the House of Representatives, in order to keep the taxing power close to the people.
